Partner-delivered services

Some services run on partner infrastructure and carry partner terms.

01About these terms

These Terms of Service ("Terms") form a binding agreement between you — or the organisation you act for ("you") — and [MilesHost legal entity name], trading as MilesHost ("MilesHost", "we", "us" or "our").

By ordering, accessing or using any MilesHost service, website or client area, you accept these Terms together with our Acceptable Use Policy, Privacy Policy, Refund & Billing Policy, Support Policy, Server Maintenance Policy and DMCA Policy (together, the "Policies"), each of which forms part of these Terms. We may update the Policies from time to time; continuing to use our services after an update means you accept the revised version. If a Policy, product description or knowledge-base article conflicts with these Terms, these Terms prevail.

02Our role & service partners

MilesHost sells, bills and supports its services directly, but many of them are delivered on infrastructure operated by trusted upstream providers. Our primary infrastructure partner is hosting.com (operated by A2 Hosting, LLC). Other products are supplied by specialist partners such as accredited domain registrars, Titan and Google.

Where a service is delivered by a partner, that partner's terms may also apply to your use of it, and we will point you to them where relevant. We act as an independent contractor: we control only the services we provide, and we are not responsible for your actions, the actions of third-party providers, or the actions of people who use your services ("End Users").

03Services covered

These Terms apply to every product we supply, whether paid, discounted, bundled or free (the "Services"), including:

  • Shared web hosting and WordPress hosting
  • Managed and unmanaged VPS hosting
  • Cloud hosting
  • Domain registration, transfer and renewal; SSL certificates
  • Business email, including Titan Email and Google Workspace
  • AI Website Builder, web design, eCommerce and website maintenance
  • Website and email migration services

We may change the features or specifications of a Service at any time, and our partners may change their offerings — sometimes between your purchase and delivery. We will make reasonable efforts to tell you about material changes. Usage limits for each Service are set out in our Acceptable Use Policy.

04AI-powered services

Some Services — such as our AI Website Builder — use artificial intelligence or machine learning ("AI Services"). AI output is automated and may be inaccurate, incomplete or different each time.

  • Use AI Services lawfully and never to create content that is deceptive, harmful or infringes the rights of others.
  • Do not rely on AI output as the only basis for legal, financial, medical, commercial or safety decisions — review and validate it yourself.
  • If you enable automated actions (for example auto-publishing), you are fully responsible for everything those actions produce or send.
  • Your prompts and materials ("Input") may be processed by third-party AI providers to generate results ("Output"); this processing is necessary to provide the Service.

05Domain names

Domain orders are passed to the relevant registries and to ICANN-accredited registrars of record (for example Enom, Inc. / Tucows Inc.) through our partners. By registering a domain you also agree to the registrar's registration policies. Because of how registration works, we cannot guarantee that a requested name will be registered.

  • Renewals are your responsibility. We make reasonable efforts to renew domains set to auto-renew, but we are not liable if a domain lapses, expires or is registered by someone else.
  • You are responsible for making sure your domain does not infringe anyone's trademark or other rights; we do not check this for you.
  • Under ICANN's Transfer Policy, a change to the registrant's first name, last name, organisation or email address applies a 60-day transfer lock. This lock cannot be waived.
  • We will comply with valid legal orders to cancel, modify or transfer a domain.
  • Promotional domain prices apply to new registrations only — not transfers or renewals — unless the offer says otherwise. We may correct orders where a promotion was applied in error.

06Hosting resources & fair use

Each hosting plan includes the resources described on its product page. To keep our platform fast and fair for everyone:

  • Bandwidth is allocated per billing period and does not roll over. If you exceed it, we may suspend the account until the next period, ask you to upgrade, or charge for the overage.
  • IP addresses included with your plan may only be used with that Service and cannot be transferred. We will email you if an assigned IP needs to change.
  • You must not place an excessive load on servers, CPUs or our support team. We may limit, throttle, suspend or terminate accounts that consistently exceed the usage of similarly situated customers.
  • Shared hosting accounts may use up to 600,000 inodes and 35 concurrent HTTP connections. VPS accounts may use up to 2,000,000 inodes.
  • "Unlimited" and "unmetered" mean usage in line with similarly situated customers.

Not permitted on shared & reseller hosting

  • Streaming media (other than incidental to your website)
  • Very large photo galleries or bulk storage of uncompressed images
  • Public file (FTP) serving or distribution of large audio/video files
  • Off-site or personal computer backups unrelated to your website

We may remove prohibited material, and delete locally stored backups, temporary backup files or oversized logs that use excessive disk space. Backups older than 30 days may be removed from shared, reseller and managed accounts. Complimentary cPanel backups are best-effort, may not include every file (including some email), and stop once an account exceeds 50 GB in total.

07VPS, Cloud & root access

  • With unmanaged services, you are solely responsible for installation, firewalls, software, security, maintenance and backups.
  • If you use root access, you are responsible for every change you make. We may not be able to reverse changes or recover data, though we will help troubleshoot as described in our Support Policy.
  • Cloud services are billed by usage: your initial payment is held as account credit and applied to future invoices, which show an itemised breakdown of resources used.

08Email services

  • Email in Trash/Deleted folders — and may also be removed from Spam folders — after 30 days, to help manage storage quotas.
  • Mailboxes are subject to the storage quota of your plan. Keep your own local copies of important email; we will try to help recover deleted mail but cannot guarantee it.
  • We cannot guarantee that every email will be delivered. Recipient settings, spam filters and IP blacklisting outside our control can affect deliverability.
  • Titan Email is operated by Titan Solution Ltd SEZC and governed by Titan's Customer Terms and Privacy Policy. Google Workspace is governed by Google's Workspace terms. These providers process your email data under their own privacy policies; ours covers the account and billing data we handle.

09Control panels & third-party tools

Some Services include software licensed from third parties, and by using it you agree to the vendor's licence terms:

  • cPanel — cPanel End User License Agreement. Each plan includes a set number of cPanel accounts; more may require an upgrade or add-on.
  • Plesk — Plesk End User License Agreement.
  • Jetpack for WordPress — Automattic's terms of service.
  • Enhance — Enhance End User License Agreement.

Control-panel usage must be in line with similarly situated customers; we may ask you to remove unused accounts, logins or licences. Some third-party tools use AI and may process your data accordingly.

10Your account

  • You must be at least 18 and have authority to accept these Terms for yourself or your organisation. Orders may be screened for fraud, so the information you give must be accurate.
  • Keep your account details — especially your email address — up to date. We are not liable for missed notices caused by out-of-date details or third-party filtering.
  • You are responsible for everything done under your login, including keeping passwords and credentials secure. We are not liable for losses caused by unauthorised access.
  • You authorise us to access your account to troubleshoot issues and check compliance with our Policies. We run automated security scans and may change permissions or quarantine files we believe are malicious.
  • You are responsible for actions our support staff take at your request. Back up your data before requesting support.

11Term, renewal & cancellation

Services begin once your payment is received (the "Effective Date") and run for the term shown in your client area (the "Initial Term").

YOUR SERVICES RENEW AUTOMATICALLY FOR SUCCESSIVE TERMS OF THE SAME LENGTH. TO STOP A RENEWAL, SUBMIT A CANCELLATION REQUEST FROM YOUR CLIENT AREA AT LEAST ONE (1) DAY BEFORE THE RENEWAL DATE.

  • Either party may cancel for convenience with 15 days' notice. Cancellations are accepted only through the cancellation form in your client area, and you remain responsible for charges for the active term.
  • Proof of account ownership and authority to cancel is required.
  • We may suspend or cancel Services immediately and without notice for a breach of these Terms or our Policies, non-payment, to prevent a network or upstream provider interruption, or to protect our network and other customers. Accounts terminated for violations are not eligible for credit.
  • You may terminate for a material breach by us that we have not fixed within 30 days of your written notice.
  • After termination, your data is deleted and associated domain packages are cancelled. We have no obligation to keep backups or forward email; recovering data from a closed account, if possible at all, requires a separate paid agreement.

Full billing and refund details are in our Refund & Billing Policy.

1230-day money-back guarantee

Changed your mind? You can cancel within 30 days of your first purchase for a full refund of the amount paid, minus any non-refundable fees such as domain registrations.

  • Available once per customer and only for the first term — not renewals.
  • Does not apply to domain registrations, renewals or transfers, servers, or certain third-party licences. Any such exclusion will be shown before you complete your order.
  • We may link related accounts when applying this guarantee.

13Availability & backups

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR CONTINUOUS, THAT YOU WILL BE ABLE TO ACCESS OUR NETWORK AT ANY PARTICULAR TIME, OR THAT DATA TRANSMITTED THROUGH OUR NETWORK WILL BE ACCURATE, ERROR-FREE, VIRUS-FREE OR SECURE.

IT IS SOLELY YOUR RESPONSIBILITY TO REGULARLY BACK UP YOUR DATA AND KEEP COPIES OUTSIDE OUR NETWORK.

We are not responsible for data loss or corruption, whether caused by our authorised actions, your use of the Services, hardware or software failure, or the suspension, cancellation or termination of an account. Scheduled maintenance is described in our Server Maintenance Policy.

14Intellectual property & data

  • We grant you a non-exclusive, non-transferable, royalty-free licence to use the Services for as long as your account is active. All rights in our technology — and our partners' — remain with us or them. You may not reverse engineer or bypass protections in that technology.
  • You keep ownership of your content. You grant us and our service partners a licence to store, transmit, cache and process it as needed to provide the Services.
  • For AI Services, you keep any rights you have in your Input, and we do not claim ownership of Output. Output may not be unique and may be subject to third-party rights; you are responsible for how you use it.
  • We handle personal data as described in our Privacy Policy.

15Testimonials

If you give us a review or endorsement of our Services, it must reflect your genuine experience. We may use and lightly edit it — together with your first name, last initial, region and likeness — to promote MilesHost in any media. Contact us at any time and we will stop using it.

16Warranty & disclaimers

We warrant that we will perform the Services in line with prevailing industry standards. To make a warranty claim, notify us in writing with reasonable detail within 30 days of the issue. Your sole remedy is, at our option, re-performance of the Service or a pro-rated credit for the affected period. Services provided by third parties are excluded from this warranty.

EXCEPT AS STATED ABOVE, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO WARRANTIES ABOUT SERVICES PROVIDED BY THIRD PARTIES, EVEN WHERE THEY APPEAR TO BE PROVIDED BY US, AND NO THIRD-PARTY WARRANTIES PASS THROUGH TO YOU.

We are not liable for content you or your customers store or transmit, for unauthorised access to or loss of data, or for breaches caused by failing to keep websites, plugins and applications up to date. Where local law does not allow these exclusions, any implied warranty is limited to 90 days from the Effective Date.

17Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILESHOST (INCLUDING ITS STAFF, OFFICERS, DIRECTORS AND AFFILIATES) IS NOT LIABLE FOR DATA LOSS; INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR LOST PROFITS, REVENUE, OPPORTUNITY, SALES OR SEARCH RANKING — INCLUDING DURING MAINTENANCE OR SUSPENSIONS. OUR TOTAL LIABILITY WILL NOT EXCEED THE FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You are responsible for the accuracy and security of anything you obtain from the internet, including AI Output. We are not responsible for force-majeure events, reboots during standard maintenance, or scheduled downtime. Uptime commitments do not apply to disruption caused by a breach of these Terms.

18Indemnification

You agree to indemnify and defend MilesHost, its partners and service providers, and their staff against claims, losses and costs (including reasonable legal fees) arising from your use of the Services, migrations you request, your AI Input or Output, any breach of these Terms or our Policies, or your acts or omissions — including those of your customers and site visitors.

We will defend you against claims that a Service fully owned by MilesHost infringes a patent, copyright or trademark, provided you notify us promptly and let us control the defence. We may then obtain the right for you to keep using the Service, replace or modify it, or end it and refund fees for the unavailable period. This does not extend to third-party products, though we will pass on any indemnities our suppliers allow.

19General legal terms

  • Compliance. You must make sure your use of the Services complies with all applicable laws, including export-control and AI regulations.
  • Disclosure. We may disclose information where required by a court order, subpoena, regulator or law, or to protect our business or others from harm, and may be prohibited from telling you. Responding to civil-litigation requests may be charged at an hourly rate.
  • Force majeure. Except for payment obligations, neither party is liable for delays caused by events beyond its reasonable control, such as third-party or hardware failures, DDoS attacks, network outages, natural disasters or civil unrest.
  • Governing law. These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
  • Claims. All claims must follow our Policies and be brought within one (1) year of the Service they relate to.
  • Other terms. A waiver of one right is not a waiver of others. We may assign these Terms; you may not. If any part is found unenforceable, the rest remains in force. Sections 13–18 survive termination. "Including" means "including without limitation".
